Standard Terms of service and Conditions of Carriage

Introduction

These Standard Terms and Conditions of Carriage ("Terms") are issued by International Business Events & Travel Organization LLC, d/b/a IBENTO ("IBENTO," "we," "us," or "our"). These Terms govern the services provided by IBENTO as an intermediary in facilitating bookings for transportation, accommodations, and other event-related services on behalf of its clients ("you," "your," or "client"). These Terms are binding and applicable to all clients who participate in events organized by IBENTO.

1. Scope of Services

1.1. IBENTO serves as an intermediary between clients and third-party service providers, including but not limited to transportation companies, airlines, hotels, and activity organizers. IBENTO does not own, operate, or control these third-party services.

1.2. IBENTO will provide a company representative on-site during events to assist with disputes or issues that may arise with local vendors for bookings made through IBENTO. However, IBENTO will not be responsible for assisting with services or activities booked independently by clients.

1.3. While IBENTO is not liable for the performance, availability, or quality of services provided by third-party vendors, IBENTO will make reasonable efforts to assist clients in rescheduling services or obtaining refunds, subject to the policies of the third-party vendors.

2. Definitions

For the purposes of these Terms:

  • "Client" refers to any individual who has purchased or reserved services through IBENTO.

  • "Vendor" includes any third-party service provider, including but not limited to airlines, bus operators, hotels, and activity organizers.

  • "Force Majeure" refers to unforeseen circumstances as defined in Section 7.


3. Bookings and Payments

3.1. All bookings facilitated by IBENTO are subject to the terms and conditions of the respective third-party vendors.

3.2. IBENTO will confirm bookings on behalf of clients and provide all necessary documentation. Payment terms, cancellation policies, and refund options will be outlined in separate agreements or sales documentation provided at the time of booking.

3.3. Clients agree that all data provided to IBENTO for booking purposes will be handled in compliance with applicable data protection regulations, including but not limited to the GDPR, as outlined in our T&Cs published on our websites (www.unibento.com and www.ibento.pro).

4. Client Responsibilities

4.1. Clients are responsible for complying with all local, state, and international laws, as well as the rules and regulations of third-party vendors, including but not limited to:

  • Transportation companies

  • Hotels and accommodations

  • Activity providers

  • IBENTO Terms & Conditions (T&Cs) and specific event rules

4.2. Clients must conduct themselves in a respectful and lawful manner during events. IBENTO reserves the right to remove clients from the event or deny participation if their behavior violates vendor rules, local laws, IBENTO T&Cs, event-specific rules, or jeopardizes the safety of others and third-party property.

4.3. Travel Documentation Requirements:

  • It is the sole responsibility of clients to ensure they have a valid passport with at least six (6) months of validity from the date the event begins if the event is held in a country different from their nationality (as indicated on their passport).

  • Clients must secure any required visas, permits, or other travel documentation in compliance with the destination’s regulations. IBENTO disclaims any responsibility for delays, penalties, or additional costs incurred due to invalid, expired, or missing travel documentation, including passport renewals or visa processing.


4.4. Local Taxes and Fees:

  • Certain locations may impose taxes or fees for the use of infrastructure, including but not limited to landing fees, regional entry fees, port taxes, or transportation access charges.

  • These fees are imposed and collected directly by local authorities or their representatives, and IBENTO does not control or influence these charges.

  • Clients are fully responsible for paying such fees directly on-site unless otherwise specified in the specific event's contract.

  • If IBENTO facilitates the collection of these fees to simplify the process for clients, this will be explicitly stated in the event-specific agreement or communicated during the event. IBENTO assumes no responsibility for the amounts or application of such taxes.


5. Force Majeure

5.1. IBENTO shall not be held liable for delays, cancellations, or non-performance caused by Force Majeure events, including but not limited to:

  • Natural disasters (e.g., earthquakes, hurricanes)

  • Political instability, war, or acts of terrorism

  • Pandemics, epidemics, or public health emergencies

  • Government-imposed restrictions or changes in law

  • Strikes, labor disputes, or industrial actions

5.2. IBENTO strongly recommends that clients purchase travel insurance covering unforeseen events, cancellations, or emergencies. If travel insurance is included in the final event package price and the client chooses not to utilize this insurance, no refunds will be provided for its cost. Clients may opt to secure their own travel insurance independently if they decline IBENTO’s offering.

5.3. In Force Majeure circumstances, IBENTO will make reasonable efforts to assist clients in rescheduling services or obtaining refunds, subject to the policies of third-party vendors.

6. Refunds and Cancellations

6.1. Refunds and cancellation policies vary based on the specific event and the terms of the third-party vendors. These policies will be disclosed at the time of booking.

6.2. IBENTO will act as a facilitator in processing refund requests but is not responsible for guaranteeing refunds.

7. Limitation of Liability

7.1. IBENTO shall not be liable for:

  • The actions or omissions of third-party vendors

  • Losses or damages resulting from client non-compliance with local laws or vendor rules

  • Injuries, damages, or losses occurring during the event unless caused by IBENTO’s negligence

7.2. Clients expressly waive any claim against IBENTO for incidents arising from the actions or services of third-party vendors.

8. Behavior and Alcohol Consumption (Specific to Spring Break and Grad Trips)

8.1. Alcohol consumption or abuse, as well as the use or possession of illegal substances, must comply with local laws and vendor regulations. IBENTO is not responsible for any incidents arising from the use or abuse of alcohol or illegal substances by clients, including damages caused by their behavior.

8.2. Clients must adhere to group behavior guidelines provided by IBENTO or third-party vendors. Any disruptive or unlawful behavior may result in removal from the event without refund.

9. Modifications to Terms

9.1. IBENTO reserves the right to modify these Terms unilaterally at any time. Any modifications will be communicated to clients via email in accordance with U.S. legal requirements, with adequate notice before they take effect.

9.2. Continued participation in IBENTO events after notification constitutes acceptance of the modified Terms.

10. Governing Law and Jurisdiction

10.1. These Terms are governed by the laws of the United States. Any disputes shall be resolved in the competent courts of the United States.

10.2. Clients participating in international events must also comply with the laws and regulations of the local jurisdiction or country. IBENTO is not liable for legal issues arising from client non-compliance.

11. Additional Information

For data protection and privacy policies, clients should refer to the Terms and Conditions published on the IBENTO website. These policies address the collection, use, and storage of personal data in compliance with applicable laws.
